Clause 137 Report
A Clause 137 Report is required when proposing internal building alterations and/or a change of use under a Complying Development Certificate (CDC) in NSW, where the existing building includes an approved Performance Solution Report.
This independent report assesses whether the proposed building works or change of use will impact or alter any existing performance solutions previously approved for the building under the National Construction Code (NCC).
The purpose of the report is to confirm that the proposed alterations or change of use remain consistent with the existing performance solution, ensuring the building continues to comply with the applicable NCC performance requirements.
Without a Clause 137(3A) Report, a certifier cannot issue a Complying Development Certificate (CDC) where an existing performance solution applies.
